What We Discovered
The Kansas State High School Activities Association (KSHSAA) adopted Name, Image, and Likeness (NIL) regulations in November 2021. Kansas currently holds a “Permitted” status for high school NIL, provided student-athletes adhere to the criteria outlined in Rule 21: Amateur Status of the KSHSAA handbook, which is linked in the high school section below. Kansas has not passed NIL legislation. College student-athletes can monetize their NIL in accordance with the NIL policies and procedures of their institution, conference, and national collegiate association (i.e. NCAA, NAIA, NJCAA). The NCAA has changed their guidelines as of October 26, 2022. Anything NIL related after 10/26/22 will refer to the new guidelines.

The KSHSAA Executive Board reviewed and approved an interpretation of the amateur rule that allows for athletes to profit from their NIL so long as it does not use a school logo, uniform, facility, or award. Game or practice tape cannot be used in promotional activities, endorsements may not influence attendance at a member school, and athletes may not promote certain industries, including gambling, alcohol, tobacco, and any banned substances or activity of any kind.

Excerpt | Rule 21: Amateur
Ineligibility under this rule holds for the entire time the student is in middle/junior or senior high school, unless he or she is reinstated by the Executive Board. Section 1: General Regulations (apply to grades 7-12)
Art . 1: A student who uses his or her athletic skill or knowledge for gain, or who plays with a professional team, or who competes for a cash prize, shall be ineligible for that sport.
Art . 2: If the student signs a professional athletic contract, he or she shall be ineligible in that sport.
Art . 3: A student who receives pay for participation in athletics is ineligible in that sport under the provisions of this rule. A student may receive pay for teaching activities such as swimming, lifesaving, golf, tennis, wrestling, basketball, dancing, baseball, etc., provided he or she confines the work to teaching skills. A student may not receive pay for coaching teams or individuals involved in competition. A student may receive pay for officiating athletic contests.
Art . 4: It is permissible for a student to accept necessary meals, lodging and transportation while competing, if such are accepted in service rather than money or other material form.
Art . 5: The acceptance of merchandise, jackets, sweaters or other wearing apparel, athletic equipment, pay for pitch- ing a game, remuneration for scoring a certain number of goals or making base hits, etc., or any other form of cash or merchandise award, is a violation of this rule. Neither may the foregoing be accepted as pay to cover necessary expenses.
Art . 6: Competing for a cash prize applies to one individual or team members. It does not matter whether the amount is sufficient to cover expenses, or whether an individual receives a portion.
Staff interpretations of Rule 21 – reviewed and approved by Executive Board 11/17/21
A student may be compensated as an influencer or representative and/or provide an endorsement pending the following:

- There shall be no interruption of the school day for the student;
- There shall be no reference to school name, school team, school logo, nor school mascot;
- Member school uniform may not be used by the student in any endorsement;
- Member school facilities may not be used in any student endorsement;
- Member school awards or awards won by students participating in activities shall not be referenced;
- No school practice film nor game film may be used in promotional activities;
- Neither endorsements nor promotions may be used to influence attendance at a member school;
- Students are not permitted to promote or endorse activities associated with the following: tobacco, alcohol, banned athletic substances, illegal substances or activities, or wagering.
