Maine voted to change their high school Name, Image, and Likeness status to “Permitted” in July 2022. The Maine Principals Association (MPA) updated its regulations to reflect this change in the 2024-2025 MPA Handbook on page 47 under “Appendix DD – Name, Image, and Likeness Policy.”

This bill prohibits a college or university from preventing a student-athlete from making certain contracts regarding or earning money from the use of the student-athletes name, image, or likeness or providing compensation for a prospective student-athletes name, image, or likeness. The bill also permits the student-athlete to earn compensation from the sale of the student-athlete’s autograph. The bill stipulates that a student-athlete may not be considered an employee of a college or university based on the student-athlete’s participation in athletics. The bill prohibits a group or organization with authority over intercollegiate athletics from preventing a college or university from participating in intercollegiate athletics in this State as a result of student-athletes at the college or university earning compensation for the use of their name, image, or likeness.

Maine has now become an approved state regarding Name, Image, and Likeness (NIL). According to the Maine Principals Association (MPA). They voted to permit NIL in July 2022 and the latest changes have been released in the MPA Handbook on page 47 under “Appendix DD”.

APPENDIX DD NAME, IMAGE, AND LIKENESS POLICY

A student-athlete may profit from the use of their own name, image, and likeness (NIL). Such permissible activities include commercial
endorsements, promotional activities, social media presence, and product or service advertisements.
No one employed by a member school, including coaches, teachers, and administrators, may be involved with a student-athlete’s use
of the NIL.

Student-athletes are prohibited from making any reference to a member school or the Maine Principals’ Association (MPA) when
engaging in any NIL activity. Student-athletes may not endorse or promote any third-party entities, goods, or services during team
activities. Student-athletes may not wear the apparel or display the logo, insignia, or identifying mark of an NIL partner during any team
activities.

Student-athletes are prohibited from engaging in any NIL activities involving the following categories of products and services:

  • Adult entertainment products and services
  • Alcohol products
  • Tobacco products
  • Cannabis products
  • Controlled dangerous substances
  • Prescription pharmaceuticals
  • Casinos and gambling, including sports betting, the lottery, and betting in connection with video games, online games, and
    mobile devices
  • Weapons, firearms, and ammunition
